Margaret Niver McGann’s practice focuses on trademark law, in both litigation and registration . She has experience in trademark infringement cases, trademark proceedings within the Trademark Trial and Appeal Board, licensing disputes, and a wide array of internet-related intellectual property disputes including UDRP proceedings.
Ms. McGann is responsible for managing the intellectual property portfolios of both local and national corporate clients and counseling clients on domestic and international brand name clearance, registration, use and protection strategies. She has directed the filing and prosecution of domestic trademark applications; directed foreign associates on registration and maintenance of international trademarks; and negotiated consent agreements counseled clients on use of licensed marks in advertising and marketing initiatives. She has also counseled clients on the development of nationwide protection strategies and helped direct and implement the policies.

- Major U.S. oil and gas service corporation - two jury trials in the Southern District of Texas resulting in finding of infringement and willful infringement of a patent and a monetary award
- Major U.S. oil and gas product corporation - Texas state court bench trial resulting in a take nothing verdict on claim of misappropriation of trade secrets and related claims
- U.S. corporation headquarted in Utah - arbitration defending against a multimillion-dollar claim for failure to timely deliver software that was resolved by the parties in a favorable settlement after the arbitration
- U.S. consumer products company - defending against a trademark and trade dress claim and request for injunction that was settled subsequent to denial of an emergency request for relief in the District of Utah
- U.S. consumer products company - claims of patent infringement related to consumer data storage products resulting in a favorable settlement immediately subsequent to hearing in the District of Utah on our client's motion for summary judgment on the majority of claims
